Streamline how content is preserved for litigation

Litigation worldwide is facing a new set of challenges with the unprecedented growth of unstructured content, making it harder than ever to ensure the right content is preserved for eDiscovery. It can be a struggle to keep up, exposing many organizations to unnecessary risk as they struggle to adapt to the new paradigm of work and successfully manage the lifecycle of their content.

eDiscovery is one of the most important, and often the most expensive, parts of the litigation process. Manually collecting content for eDiscovery can be time-consuming, and content fragmentation makes it hard to find, preserve and analyze the content needed for litigation. Gartner’s Strategic Planning Assumption for eDiscovery solutions estimates that by 2023, due to speed and legal cost, 70% of complex e-discovery cases will be managed by in-house IT leaders, up from 20% today. Using Box, companies can streamline and improve how content is discovered and preserved for litigation matters, all without impacting the experience of end users.

What is a Legal Hold?

A legal hold is a process that an enterprise can use to preserve any content pertinent to a legal matter from being permanently deleted. A legal hold may be issued as a result of current or anticipated litigation, audit, or government investigation. During the Legal Hold process, employees under review are required to preserve all documents and information that may be relevant to the specific legal matter. The ultimate goal is to prevent any deletion of potentially relevant evidence.

The Box Governance Legal Hold feature gives Admins the ability to identify, preserve, and export content that is stored in Box. Legal holds are a crucial component of an organization’s eDiscovery strategy, that help to ensure that Box content related to legal matters is properly preserved. Legal holds can be placed on both content that individuals own and content that an individual interacts with. Holds can be applied retroactively, as well as ongoing, placing holds on new content an individual has accessed. Applying a hold prevents any user from deleting content pertinent to the legal matter within Box and can be set for a period of time or continuous until the legal matter ends.

Introducing Legal Hold export

In the last 5 years, Box Governance has seen a 1,150% increase in Legal Hold feature usage applied to content. So, today, I'm excited to introduce Legal Hold export as part of our Governance offering.

Legal hold export will allow admins to export documents on legal hold for legal review, as well as provide the ability to select custom filters to narrow scope and improve relevancy of exported content, including trashed content. Content will be able to be filtered by date, user, and file type, and the export will automatically batch and monitor large exports for more reliable downloads. Legal hold export will extend Box’s eDiscovery capabilities by allowing the identification and preservation of content subject to litigation, as well as the export of that content.
